The SECURE Act changed inherited 401(k) rules. Most non-spouse beneficiaries must empty the account within 10 years. Spouses have more flexibility including rolling into their own account. Eligible designated beneficiaries (minor children, disabled, chronically ill) can still stretch distributions over their lifetime.
Beneficiary Categories
- Spouse: Rollover to own account, treat as own, or 10-year rule
- Non-spouse: Must distribute within 10 years (SECURE Act)
- EDB: Minor children, disabled/chronically ill - can use life expectancy
